A man has been sent to jail for 30 years for repeatedly defiling and impregnating his 13-year-old step-daughter in Taita Taveta. Julius Mwanjewe Mwamburi appeared before the Wundanyi resident magistrate K.I.Orenge who found him guilty of the offense.
Mwamburi was charged that on diverse dates between December 2008 and April 2009 at Chawia village in Mwatate, had unlawful carnal knowledge of the standard six girl contrary to the Sexual Offenses Act of 2006. He also faced an alternative charge of indecently assaulting the girl by touching her private parts. The prosecution lined five witnesses who gave evidence before the court.
The complainant told the court that she was at home with the accused who is her step-father when he asked her to accompany him to the farm to pick mangoes, but before they left he called her into his room and put her on bed and defiled her.
In mitigation the accused prayed for leniency of the court saying that he was the sole breadwinner of the family and that he was HIV positive and prayed for non custodial sentence.
